OK - so we downloaded the app to our son's ipod touch, set the passcode, and set the restrictions. All is great. Now, after he turns off the itouch and wants to get back on it asks him for his passcode. WHAT!!!! why have a passcode to protect the restrictions and turn off the safari browser if he has to have the passcode just to use the thing in the firstplace, thus giving him the power to do an endrun on the protection when we aren't around, or requiring us to be around for him to use the itouch!!! Help! Am I missing something?

Restrictions and Passcode Lock are two different settings.

It is understandable that you are confused by this. The Passcode to enable or modify Restrictions settings can be different from the Passcode used to lock/unlock the device. Each can be a unique 4-digit alphanumeric passcode.
To set Restrictions Passcode, you select
Settings > General > Restrictions
To set the general Passcode Lock, you select
Settings > General > Passcode Lock
If you do not want the device to go into Auto-Lock (where you need to swipe the screen to enable), you can turn it off as well by selecting
Settings > General > Auto-Lock > Never
